How does the prosecution ever do it? It seems like every District Attorney would need their own Hercules to lift that such a monumental trial burden.
Good, damnit. Good. It should be hard as hell to put someone away in jail. It should be, to the utmost extent, out of the control of the attorney. The evidence should have to be overwhelming, persuasive, and unambiguous--beyond a reasonable doubt. The attorney, in theory, should only be the arbitrator of justice. Of course, that's not exactly how it works, but to the greatest extent possible, the burden should be so heavy that it allows little human wiggle room for corrupting and unjust prejudice or manipulation.
